This website, found under www.purebaby.co.uk, is operated by Pure Baby Limited ("Pure Baby") and references to "we", "us" and "our" shall be deemed to be references to Pure Baby. References to "you", and "your" shall be deemed to be references to person placing an order via this website.

Customer Orders

By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these terms, then you should contact one of our customer service advisors before placing an order with us either by telephone on 0207 751 5544, by email at: enquiries@purebaby.co.uk or by post using the address given above.

By placing an order via this website you are making an offer to Pure Baby to purchase the goods detailed in your order upon the terms described in your order.

Once you have placed an order we will send you a confirmation that your order has been received but this is not a confirmation that your offer to purchase the goods has been accepted. A contract between you and Pure Baby for the sale of our products will only exist once an order has been accepted, processed and despatched to you.

Prices

The total price payable will be stipulated at the time when you place your order whether or not the order has been acknowledged. We are entitled to make adjustments to the price to take account of any increase in our suppliers' prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been acknowledged. We will inform you of the correct price and give you the opportunity to cancel the order. All prices are inclusive of VAT but exclusive of delivery charges which will be payable as indicated at the time the order is placed.

From time to time the prices displayed on our website may be different if you are directed to it from a third party website. Purchases at these prices can only be made on our website and by arriving on it through a relevant third party website; these prices will not be available in-store or over the telephone.

Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If a product becomes unavailable we may offer you an alternative or suggest that you (re-)visit one of our stores.

On occasion, the prices payable and promotions offered in respect of goods advertised on the website may differ from those prices and promotions offered at the same time in-store. We are under no obligation to honour any in-store price or promotion in the event that they differ from those on the website. Similarly, our store is under no obligation to honour any website price or promotion in the event that they differ from those in-store.

Although we endeavour to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.

Prices that are reduced for sales and promotions are only valid for the specified period.

Order Processing

Your order is sent directly to our secure till in our shop for processing. Once we have received your order and payment, our staff will pick, pack and dispatch the item. We will aim to do this the same day for all orders in to our shop Mon-Sat (excl Bank Holidays).

Your Right to Cancel

You may normally cancel your order (once accepted by us) for any reason up to the point of despatch. If you do cancel the contract within this time any payments made by you will be refunded in full within 30 days. If you wish to cancel your order after it has been dispatched, you will be charged for both delivery and collection cost.

Payment and Taxes

We accept online payment in a secure environment by credit card or Pure Baby Gift Vouchers. We currently accept Visa, Mastercard, Delta, Switch. All transactions are shown in pounds sterling (??).

All prices quoted on this website are accurate at the time of publication and are quoted in pounds sterling (??) and where appropriate are inclusive of UK sales tax (VAT) at the current rate. If your order is being despatched to a destination outside the European Union (EU) then your sales tax will be zero. If your order is being sent to a member state of the EU then the selling price will include VAT at the current rate. The current rate of VAT is 20.00%. Any customs or import duties levied once the package reaches your destination country will be your responsibility as we have no control over these charges and cannot predict them.

Security (SagePay)

We use the industry leading internet payment company SagePay to protect your card details and protect us from fraud. The following security systems are used.

Transaction security. All transaction information passed between merchant sites and the SagePay VSP Systems is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to your servers from SagePay are signed using MD5 hashing to prevent tampering. You can be completely secure in the knowledge that nothing you pass to the SagePay servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.

Encryption and Data Storage. All sensitive data is secured on SagePay using the same internationally recognised 256-bit encryption standards used by, among others, the US Government. The encryption keys are held on state-of-the-art, tamper proof systems in the same family as those used to secure VeriSign's Global Root certificate, making them all but impossible to extract. The data we hold is extremely secure and we are regularly audited by the banks and banking authorities to ensure it remains so.

Links to banks. SagePay has multiple private links into the banking network that are completely separate from the Internet and which do not cross any publicly accessible networks. Any cardholder information sent to the banks and any authorisation message coming back is secure and cannot be tampered with.

Employee access. No individuals within Pure Baby or SagePay are able to decrypt transaction information or cardholder data. Our systems only allow our most senior staff to access them and only in extenuating circumstances (such as investigations of Card Fraud by the Police). Your transaction information and customer card information is secure even from our own employees because our systems never display the full card numbers, even on administration screens.

UK Delivery

Delivery is charged as priced on each order. Stock permitting, all orders are usually despatched within 24 hours of being accepted, to arrive with UK customers within seven working days. In the event that an item is temporarily out of stock, we will notify you of the delay and despatch it as soon as it arrives.

If you are unavailable when our delivery partner tries to deliver your order, they will usually try to deliver again the next working day or they will drop a card in to offer you a collection from a local collection point. If you should refuse delivery of goods, or are not available to accept the delivery on both delivery attempts, you will be required to cover any extra costs incurred.

All quoted delivery prices are for most UK Mainland addresses. For overseas and non-mainland UK addresses postage is charged at cost and may also experience delivery delays. Morning, Saturday and "next working day" deliveries are optional and will also incur additional charges. Delivery of large items will be charged individually - please see individual products for charges.

We will only deliver goods to the address on the order.

Availability

If you are ordering goods that are out of stock we will dispatch them when they are received from our supplier.

On occasion goods are subject to availability and delay in delivery of goods is sometimes outside our control. As such, delivery cannot be guaranteed and any dates we specify for the delivery of the goods are approximate only. We shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods.

Conformity of Goods

We take every care to ensure that the description and specification of our products are correct at the time of going to press. However, specifications and descriptions of products on this website are not intended to be binding and are intended only to give a general description of the products. Furthermore, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you.

Returns Policy

If you are not entirely delighted with the products that you have chosen you may return them to us within 30 days of receipt. We will be more than happy to offer you an exchange or, if you wish, a refund provided that the products are returned complete, in perfect condition, unused, unwashed and with the original packaging. We cannot accept items for a refund or exchange if the goods are not in perfect condition or it is obvious to us that the goods have been used or washed.

Making Returns

For all returns, except where the item is faulty, you will be required to arrange and pay for the return of the products to us. If you prefer, we will arrange to collect the products from you, but the cost of this will be charged to you and may be deducted from any refund to you. We will only refund the costs of postage where the item returned is faulty.

To return any products to us, please complete the returns form (which comes with your order) and clearly mark whether you would like a refund or exchange. Pack the items back in the parcel, attach the invoice and send it back to:

When returning items you are strongly recommended to obtain proof of posting. We cannot accept responsibility for parcels lost in transit.

Disclaimer and Limitations of Liability

Pure Baby does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its members, agents, directors or employees or for any fraudulent misrepresentation.

To the fullest extent permitted by law and save as provided above, neither Pure Baby nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Pure Baby or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.

While Pure Baby uses reasonable endeavours to ensure that the information on this website is accurate and up to date, it does not give any warranty as to its accuracy or completeness and Pure Baby will not be responsible for any errors or omissions or for the results arising from the use of such information.

While Pure Baby takes all reasonable steps to ensure a fast and reliable service, it does not guarantee that your use of this website will be interruption or error free and will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.

Further, Pure Baby will not be responsible nor liable for your use of any other websites which you may access via links within this website. Pure Baby does not control these websites and is not responsible for their content. Any such links are provided merely as a service to users of this website and their inclusion in this website does not constitute an endorsement by or affiliation with Pure Baby.

The entire liability of Pure Baby under or in connection with any contract for any products to which these conditions apply shall not exceed the price of the products, except as expressly provided in these conditions.

Pure Baby will not be liable to you or be deemed to be in breach of these terms and conditions or any other contract with you by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products ordered by you if the delay or failure was due to any cause beyond its reasonable control.

Pure Baby may assign or transfer any of its rights or sub contract any of its obligations under these terms and conditions to any third party. You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with the specific permission in writing of Pure Baby.

No person who is not a party to these terms and conditions shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.
